Weaker in the sense of benefits, absolutely. Things like vacation, paid maternity leave, etc. We suck with that, but thats a political thing as much as anything else, where there are ideological pressures against people getting paid when they aren't working. Which is an arguable point, really. (Disclaimer: No, I don't agree with it, but I get where its coming from.)
When it comes to discrimination....does the rest of the developed world protect against discrimination against gay and transgendered people? Or fat people? (obese people in particular are extremely badly treated by potential employers) Because we mostly don't. But the usual race, religion, gender, age, national origin, disability, bankruptcy, citizenship, etc., are specifically protected groups under law.
I'm just having flashbacks to when our little firm first incorporated and the enormous pile of employment legalese was being worked through. Its almost to the point where if you are the kind of place with any amount of serious turnover you need to retain legal services just to avoid being obliterated by coincidence. We haven't hired anyone but painters in about 4 years, so its been no problem for us. Other (much larger) places almost give the impression of having to have a full time legal aegis to defend against any perceived violations.
