I'm ok with a public safety delay in reading the miranda rights, but they should still apply eventually. This man is a US citizen, and I have seen no proof that he's cooperating with any foreign enemy, so I don't think you can possibly label him an enemy combatant.

This only will become an issue if they try and use unmirandaized statements against him in court. Based on all the other evidence I doubt they will.


As to treating him as an enemy combatant that's both silly and scary.

if he still has no counsel then they are trying to figure out the other people that are involved. from what im reading, he tried to kill himself and f**k that up because he's a f**k up and now he has to write out his answers, so it may take a while

So it looks like they're not going to label him an enemy combatant. But they are charging him with using a weapon of mass destruction!!??

I really don't see how this could be described as a WMD by any rational person. Is it a trumped up charge to make sure he's eligible for the DP? If so , that is worrying, imo.

I think they are stretching the public safety exception, but again it may end up being a non-issue.


The enemy combatant thing has be more disturbed. The guy's a US citizen committing a crime on US soil. I'm just not seeing the enemy combatant thing.
