This is why it is important to read all the terms of what you are agreeing to and to know the applicable laws. Yes, writing bad checks are illegal. When you write a check that is dishonored the law gives you a certain number of days to redeem that check in full plus a service fee. If you do not, then you can be prosecuted for having written a non-sufficient fund check. This includes electronic checks in many states.
Of course, in many places if you accept a check knowing the funds are not in the account when you accept it (in other words you hold the check for collateral to present later) you cannot bring criminal charges but only civil.
In Georgia, we banned payday loans many years ago. When the law was passed, the liberals swore that the republicans who passed it were going to destroy the poor because they depended upon these type of loans. They railed against the laws for a while then it faded from interest. Are payday loans a bad thing? It depends on if you need the money so bad that you are ready to hock your kid's Xbox. The big problem now is title lending.
