well i feel like any eventual challenge of the NSA will be part and parcel with proving some sort of harm through violation of ones rights.

OK, so the topic has strayed a bit into NSA spying on US citizens.
Let's go back to the OP. Should the NSA spy on foreign people? The head of the NSA defended this practice pretty rigorously yesterday. And, I tend to agree with the talking points that I heard. First, that other countries are most certainly spying on us, so we need to spy on them. That, just because a country is an "ally", doesn't mean that they always have the best interest of the US in mind.
