Loosies are sold in bodegas all across the city. Just cause a couple store owners in Staten Island (most of whom were probably also selling illegal cigarettes) complained about guys on the street corner selling until the cops stupidly decided to appease them does not mean that "New York City thinks it is a problem". Find me one poll of New Yorkers ever where "guys selling illegal cigarettes" even cracks the top 20 concerns of New Yorkers. You won't be able to because New Yorkers never gave a shit about this issue. You simply made up a giant heap of bullshit and used that as the centerpiece of your futile argument.

Cops disregard official policy and the law all the time. In many parts of many cities around the world laws are flaunted continuously. In NYC for example there is a giant open air counterfeit goods market on canal street that continues to operate even with a police presence.

In many cities you can openly smoke marijuana and drink in public without fear from the police officers. Selling loosies are a minor offense, akin to jaywalking or drinking in public. The officer has complete discretion on whether or not he wants to initiate a confrontation.
