If they are not married, they legally cannot make decisions about end-of-life care, have to pay more taxes, etc.

Galt, that whole argument is flatly nonsensical. How is a straight man being restricted from marrying women any less discriminatory than a gay woman being restricted from marrying women? Like most discrimination, all you have to do is hold up a mirror and look at the reverse to see how f**k up it is.
How is anyone being restricted from marrying half of the population, and 100% of their potential actual mates, not discrimination? Its very specific discrimination. By this logic you could justify "blacks only" drinking fountains because there is a "whites" drinking fountain 15 feet away. "Its not really discrimination to restrict X on the basis of a, because X could always just pretend to be Y on the basis of a." Cool story.
