That's not a compelling argument that this is illegal. If anything, it just makes clear this is in fact legal because no court has overturned the Justice Departments application of the balancing test. The balancing test for due process has been established in law well before this case. You just don't like how they balanced things. But that's not any foundation for making an argument that this is illegal.
