How far does attorney/client privilege go? I always thought it was very robust but I don't actually know.

Basically don't talk where somebody else can listen and don't plan a crime. The relevant one here is probably the latter which IIRC is the "crime-fraud exception."

There are other niceties especially in mergers and involving outside sponsors but obviously not the relevant one here.

Edit: to be clear if the cops and prosecutors don't think attorney client doesn't apply here i'm inclined to agree with their assessment. this is not a measure taken by somebody on the fence or who thinks it's a close legal call......
