I think you're looking at it the wrong way. His voting against things such as the Patriot Act show his pragmatism. It's the rest of Congress that's ideological. The ideologues just happen to vote together.

You pick your battles. Voting against the Patriot Act because the very principle behind it is unconstitutional is different than rallying against the Civil Rights Act 30 years later because you're a market libertarian.

The patriot act and the civil rights act are different animals.

The only reason a civil rights act was ever necessary was because of the poor character inherent in much of the US population at the time. The Patriot Act is a just a blatant power grab by an out of control state.
