Is having laws/protocol that allows someone to be gang tackled and arrested for trivial things like selling a cigarette really who we are? If so, then we should fire Congress, round up all the resident Nazi's and give them lifetime appointments to replace the fired Congress. Imo, people who conjure draconian laws like that (cigarette law) should be removed from making laws forever.

The law isn't to blame. It SHOULD be illegal to sell items without remitting sales tax (which is why it's illegal to sell individual cigs). And, it SHOULD be OK to arrest those people to enforce the law.
However, it should NOT be OK to INITIATE violence upon someone when arresting them. If they refuse to place their hands behind their back, you reach for their hand to cuff them. You don't "assume" that they will physically resist, and immediately move to the next rung (or several rungs up) the Force Continuum ladder.
