I really don't know the answer (and neither do you). I find resorting to UK common law fairly persuasive, since the drafters were steeped in UK common law. The purpose of making the reference could have been to carve out the two specific examples they mention in the following provisos. I would not have drafted it that way, but we are better drafters today than they were so who knows.

If the constitution intended natural born citizen to include those born outside of the us to us parents, then why the need for the 1790 act?
