This isn't being used as a strict identification technique though. It is an investigative tool.
Guy was arrested for assault, mandatory DNA test, then gets charged and convicted for a past rape based upon that evidence.
No warrant, no probable cause, no prior conviction. That is quite a bit different than a fingerprint that can only be used to prove that a person was on the scene, which doesn't say anything about their guilt or innocence (necessarily).
