I don't think it was a bad ruling, it was the only tangeable demarcation in a huge soup of subjectivity and idiocy. Marriage is not a contract, that's the language of manufactured morality. Marriage is for tax purposes. The relationship has contractual dynamics, all of which are unique to the couple. That is a fact.

If the judge had ruled it as adultery would she have been entitled to the payment?
Sigmund Freud defined four parts of a psyche; the id, the ego, the superego and the stratego. The Stratego being the highest form of morality and scientific thinking.
