Ah, so your new theory is not that the above was Congress's intent, but merely that it was the intent of several legislators who required that language before they were going to vote for it? That makes even less sense than your original position.
Congress's clear intent was to expand access to healthcare insurance. Arbitrarily denying a tool to increase access to the citizens of states that failed to set up exchanges makes no sense whatsoever in this context. Indeed, were Congress going to take these rather odd step, they would have explicitly said somewhere that there are no subsidies available on federal exchanges, don't you think? I mean they had 900 pages of territory. If Congress's intent was to arbitrarily deny X group of people subsidies, they would've said it, don't you think?
