Would the gov't be injured? yes. It would have to pay money if the rule came against them. Did they appeal? yes. Therefore standing established.

Even if that wasn't enough, which it is, Kennedy demonstrates there are extraordinary circumstances that the SCOTUS laid precedence to intervening anyway and explained why this would be one of them.

I find it funny that the Left wants to do away with the electoral college and let the popular vote determine elections. But when the popular vote of the people of California (prop 8) does not match the Left's goals they use an end-around to negate the popular vote to achieve their political goals. The end of ballot initiatives as I see it.
