Holder kept dodging the question over and over and over. He kept sticking to a non-answer that the U.S. hasn't done it and doesn't intend to do it. Sen. Cruz refused to budge because Holder wasn't giving him a definitive answer. Intentions. Appropriate. Words that mean absolutely nothing in regards to what is constitutional or not.
Finally, at the end, after being asked the same question several times and giving the same bullshit response several times he finally said "no". This man is the Attorney General and, of all people in the administration, is supposed to know exactly what the Constitution states. It was kind of obvious that Holder did not want to get pinned down to actually stating what the law says and going on record saying it.
