I think it would get dealt with if, say, the next president used the bully pulpit to push reform. Or there was some high-profile case, unfortunately, where it was shown that we just executed an innocent person.
Right now it's basically don't ask/don't tell apparently with the American public.
And then, yes, there will be the red state politicians who will appeal to the "law and order" casual barbarity of their voters by not budging on the status quo.
