Now, I will say that sometimes a President can get away with not enforcing certain laws if he deems it impossible to execute the law given the resources he has at his command. For instance, he told Congress that he was unable to execute certain parts of immigration laws, because Congress did not give him enough money to do so. Sure, the things he chose to ignore were politically motivated. But, legally, he had ground to stand on.
But, this was not a situation where he didn't have enough money and had to transfer them.
