more weird is the other case, in that who wrote for the 5-4. in the other case it says there was lack of right to appeal it so it sidestepped: roberts, scalia, ginsburg, breyer, and kagan for the majority

Yeah!
I kind of see your point, Galt, about how states may have different standards. And, there are areas where that is a valid concern. For instance, the Fed may give/withhold funding for interstates if a state puts certain speed limits on Federal highways. But, speed limits apply to all people equally. I'd have no problem with the Fed withholding funding if a state said that gay people must drive 55, while straight people can drive 70.
Also, marriage is a state institution. So long as a state doesn't make laws that interfere with personal rights (including class rights), then the Fed should not be able to tell a state what to do.
