After three years you can't really claim to be holding the man for questioning, at that point you are just imprisoning him without a trial. Unless they have something to charge him with, he should have been released a long, long time ago.
Obviously this would not be happening if he knew his rights and could afford a decent lawyer, but it seems he doesn't, so Oregon has apparently decided to take advantage of his lack of power/knowledge. Just another example of Justice not being blind at all.
