The most they should be able to do is charge him as an accessory and go to trial with what evidence they have. I don't agree with coercive detainment. I can't imagine how after a few months it doesn't automatically become punitive sans due process (or as I like to call it, illegal).

What other way do they have to make this man show up at the trial? Maybe they should have held the trial a little sooner and not allowed so many delays. Of course, it's a lot harder to get a conviction without a body but if the kid has confessed to the murder???

After three years you can't really claim to be holding the man for questioning, at that point you are just imprisoning him without a trial. Unless they have something to charge him with, he should have been released a long, long time ago.
Obviously this would not be happening if he knew his rights and could afford a decent lawyer, but it seems he doesn't, so Oregon has apparently decided to take advantage of his lack of power/knowledge. Just another example of Justice not being blind at all.
