While I understand they want a certain "look" for their employees, if they can't be more diplomatic about it than to make it legally obvious that they didn't hire you because of your religious garb, they deserve to lose the case.

I was under the impression that the head scarf was a culture thing, and not directly linked too Islam.

But, if the decision was 8-1, I'm sure it was for a good reason.

The head scarf is such a mild accessory too and I would think adds that kind of international "flavor" that a vendor like A&F would want.

Ya, I guess majority rulings don't always equal good results. But, in this day and age, I doubt you'd see any rulings like plessy. I should have stated it must have been a strong case by the plaintiff if the liberal and conservative judges came down on the same side.
