I am very much in favor of this proposal, but I don't think it has any chance of actually passing. Regardless of who wins the presidency, gerrymandering will ensure that Republicans keep control of the house, and they are never going to vote for this. Privatizing government functions + locking people up are two of their favorite things.

Were I a state's AG, I would challenge the application of this to how I operate my prisons in my state. And maybe win.
They'd probably have to make banning it conditional on receiving certain federal funding, which would work I think (constitutionally).
