Or, as in this case, they can just throw everything at the wall and see what sticks, which is just as bad as any of the problems you mentioned. Perhaps worse, actually, because it results in somebody having something bad happen, whether they committed a crime or not.

i wonder how much casey anthony is influencing this judges decision to allow the jury to go with the lesser charges?

well it was an instance where going after the maximum charge, instead of something one could prove, led to someone who was most likely guilty getting off completely. and the prosecution for this trial is making the same mistake.
