At least for now, I don't think he can be convicted. Sure police may have a slightly more convincing case. But, only slightly. The evidence I've heard:
- neightbor 300 meters away heard them arguing
- another neighbor heard 2 shots, and then 2 more shots 15 minutes later
- there was a history of allegations of violence, abuse, or something
- the gun holster was under the bed, so he would have known she wasn't in the bed
- shots were fired at a trajectory indicating he had his prostheses on
Eynon, you're a public defender - I'm pretty sure you could poke some large holes in each of those facts.
- neighbor 300 meters away was too far; could have been hearing a TV from somewhere else; could be a media whore looking for attention
- I doubt this story, as the police would be able to tell very quickly if 2 shots came post-mortem
- history of allegations proves nothing
- it was pitch dark; he might have seen lumps in the comforter (she was skinny and could have sunk into a pillowtop mattress - I've been laying like that before and my wife said he had no idea I was there, and the lights were on!)
- the prosecutor said he had no evidence that contradicted Pistorias' story, including the part where he said he didn't have his legs on; does this "lack of evidence" include shot trajectories?
