I'm not saying he doesn't have some interesting points I'm saying depending on the industry, waiting until disaster strikes and then saying well hey, at least they're getting fined/going out of business miiiiiiiight not fly with a lot of people.

The only other thing that makes me twitch is we were told by all the free-market people that we shouldn't regulate things like Wall St./derivatives because the free market would punish fraud and bad actors would risk going out of business. Oops.

I see his points though.

Medius hit on this, but regulation is being used as an excuse to limit litigation, which in fact encourages bad-actors.

So...in some cases regulation is harming the very thing it's supposed to uphold....with a lot of help from this Supreme Court.

You mean because the bad actor can shift the blame onto the regulators allegedly not doing their job?
