It was an accident. One with clear criminal fault, but not intent. Certainly I agree with others that there should be some civil (monetary) impacts. I think the probation is fine, however, I do think they should pop him at least 30 to 90 days in jail so he knows where he is going if he doesn't take his one and only chance and put himself on the right track.
The defense argument is laughable and that lawyer should be socially ostracized for coming up with it.
