well considering that land belonged to that indian nation before it was stolen by congress i don't see a problem here.
what has changed for the people of that town? absolutely nothing.
and the EPA doesn't need to be written into the constitution for it to be constitutional. the constitution is not a document of positive liberty. the fifth amendment states citizens have the right to argue their claims in a court of law, which the EPA doesn't negate.

Land that's returned is given back based on treaty rights or reexamining illegal land deals. Your mischaracterization of events is just flatly wrong.
