The ruling wouldn't have been unanimous without the nuclear option. You keep ignoring this but even you didn't believe it would be unanimous (you were actually quite certain on the two who wouldn't go along).
It's a stupid argument to be had, the landscape is no longer the same. I don't even understand why they decided the case. The decision has no effect on anything, there was no remedy. It was weird.
