Oh and what Jefferson thought doesn't really matter?
You cannot tell me that vigorously defending the expression of one religion (and even stretching that definition to absurd ends) but not others isn't de facto establishment of a state religion even if it's not explicitly stated as such.
What exactly do you think the definition of a state religion is then? Like, they put it on the license plates and that's the end of it--"Welcome to Kansas: Where if You Can't Throw a Football You Best Know How to Throw a Bible!"?
No, you either persecute the other religions or don't give them the same protections as the established religion. Well, if you're not killing them.
