Honestly, I don't know how you can legislate this, very complex issue.

You might say the law should be "No means No" rather than "Yes means Yes", meaning a women would have to let the guy know that she does not consent, in order to avoid misunderstandings like this. However, there are many cases where that won't work, for example you cannot say No while unconscious. Also, if you really are dealing with an intentional rapist, objecting too strongly could put the woman at risk of further violence.

When alcohol is involved, rape is probably impossible. Most said rape is probably a case of the ass retribution. Do as I say, or I will f**k you over.

Yeah, I'm not sure why we have to classify holding someone down and forcing yourself on them as they beg you to stop and a drunk hookup that is later revealed to be of dubious consent as the same crime.

Well yeah. I have to say that just because someone is physically capable of kicking your ass doesn't mean that you're being coerced when you agree to something with them. Context matters here. If the guy has behaved in a way that gives her reasonable cause to believe he will hurt her if she doesn't give him what he wants, that's one thing. Just cause he potentially could hurt her doesn't mean she has reasonable cause to believe that.

I'm 5' 10" and not particularly jacked. If a 6' 4" guy built like a linebacker politely asks me "Hey can you spare a couple bucks for train fare?" and I give it to him, that doesn't mean he robbed me. If he backs me into a corner, pushes me against a wall and demands it, then yes, it would be robbery.
