Gotta agree with Galt here. We've long separated casual sales from retail/wholesale operations.
Galt's analogy to ADA requirements is fairly apt (broken clock twice a day, etc.

well there are a number of laws around it but basically if you do X amount in sales or beyond, and 75% of them are direct to customer, you're a retail establishment. you'll need to pay taxes, pay employees minimum wage etc. if a garage sale is a retail sale are you going to tell me your child labor now get minimum wage?
