I think it's nuts. It's just one step closer to extra-judicial killings. Feds haven't executed anyone in 15 years. On top of that - this would be inordinately expensive under current precedent (Anybody got 15,000 lawyers willing to spend time arguing capital punishment?). We could go all Texas on it and utilize a bicameral set up but even that has been criticized by Texans as being too onerous. But c'mon...state sanctioned murder should be hard to do.

Ok...so? AG of the US just released a memo instructing prosecutors to utilize capital punishment on certain cases. That's a bit unusual no?
