I think it's nuts. It's just one step closer to extra-judicial killings. Feds haven't executed anyone in 15 years. On top of that - this would be inordinately expensive under current precedent (Anybody got 15,000 lawyers willing to spend time arguing capital punishment?). We could go all Texas on it and utilize a bicameral set up but even that has been criticized by Texans as being too onerous. But c'mon...state sanctioned murder should be hard to do.
