your proposal really has nothing to do with "property rights" being modernized, it has to do with inequality. "property rights" being "modernized" could be a call to say, get rid of landed property (which is disagree with but then you are actually talking about "property rights")

I sort of agree, but this is a serious modification of our understanding of property rights. The idea that they are valid only onto a certain point is the central argument here. It may not be how the courts would rule it, but I think you get what I mean.
