I'm not sure I understand your position.
You don't agree with Marbury v. Madison - Judicial review was a power grab by the court
But if a POTUS tried to or even stated the intent to stack the court you'd be all against it? It would seem to me that Marbury v. Madison empowered the court the act as a check on all branches of the government, Executive included and especially relevant here, but you'd fight against stacking the court because you like that it does what you don't like?
It this all just because POTUS would try to do it and not Congress? What if members of congress formed a plurality and passed legislation allowing POTUS to unilaterally appoint SCOTUS judges?
