Eh, not sure this is as big of a deal as you make it out to be. President uses this authority routinely, and did so within the US after 9/11. I don't think there is any LEGAL ambiguity here, the president does have the power. Any legal case would therefor probably turn on the facts and circumstances, i.e. is this military construction in response to a natl emergency. Let Trump do it, it's actually a very WEAK exercise of the powers granted to the president. Dems can shove it in dry when they take back the white house. I don't care if this is some absurd expansion of executive authority (it's not), congress NEVER gets shit done anyway. It's 5 billion dollars, the only reason the dems are fighting this is for politics, to avoid allowing trump to deliver on THE campaign promise before 2020. They don't give two shits about the country, its institutions or its norms either.
I suspect Trump has decided to do this and the staff are trying to concoct it in a way that will pass muster with the courts. I actually don't think it will be difficult to establish there is a crisis on the border in need of a military response - dems keep saying the numbers are down and they are, but that completely misses the point (and naturally starts from a VERY high base during the Bush years). Illegal migrants won't be the pretext, criminal gangs and drug runners will be. Again, not as hard to justify a military response when you put it in those terms. haven't seen anything to indicate the Trump Admin has its ducks in a row and is able to get this right, but they could pull it off.
