So I actually looked this up because I don't know much about wholesale power markets, and the regulator is really NERC (overseen by FERC and the Canadian government) and various state Public Utility Commissions. FERC, however, can kind of bully these organisations since it oversees wholesale markets and transmission across state lines, and can set tariffs and mandate open access, which effectively manages the prices and demand for energy and capacity. The DOE is the one that actually sets policy and then leaves it to FERC and NERC to kind of carry it out.
None of this applies to Texas basically, and FERC cannot bully them because again, no true wholesale market or transmission crossing Texas state lines. So the PUC in Texas is basically the sole regulator.
