If anything it makes it worse. There was oodles of evidence showing legitimate medical purposes for pot and a state interest in permitting its use for medical treatment. Take that away and Raich is even more one-sided against teh dope.

It will be a legal f**k because while it's conceivable the DoJ will utilize the commerce clause to go after the business end, the initiative specifically allows for personal growth and use. There is a very good case to be made that this is similar to liquor: without a license, you can't legally sell liquor, but you can produce as much as you want for yourself and as a gift.

Also lol'ing at everyone on this forum who hates on direct democracy when it's been demonstrated countless times that people are more thoughtful than their representatives.

I do think Eric Holder and the DOJ will rattle their sabers about legalized pot, probably storm a few small, private, grow houses in order to scare people. But, I can't help but wonder what this does to the larger "States vs. Feds" problem. There is already a lot of anti-federal sentiment brewing in various state legislatures around the country...wonder if this will tip the scales further.
