I think there is definitely an unsaid position that women have a stronger claim over children than men. Its seen as some sort of terrible thing for women to have "their" children ripped away...but it happens to men all the damn time and nobody bats an eye. There is no legal basis for this, but the courts are run by people and so the bias shines through pretty reliably.
