Supreme Court going to look at DOMA, prop 8

I'll have to read up on it more before I render a prediction. I was off by 1 justice on the ACA and don't want to make that mistake again.

That said, it seems apparent to me that it's an EPC violation.

This is huge. This is a crest of a culture shift, and it's gonna be a moment of serious judicial activism. There is no way that they will write an opinion perpendicular to the evidence presented in this election.

I just didn't think they were gonna take it this year. The fact that they took both DOMA and 8 at the same time, to me, based on tendencies in history is proof, they are resolving it with one strike. Clean sweep for progressivism.

even if doma is ruled unconstitutional (and i think it would be for a few reasons) the public policy exception would hold and gay marriage would not be forced on the separate states. i think this could set up nicely even more state's rights wins for when the ussc inevitably goes to pot. prop 8 is entirely constitutional
