I've always thought that DUI should be a sentencing factor, not a crime, although I doubt such a position would be popular.
I know lots of people who can drive perfectly fine while "legally drunk," and lots that shouldn't drive after a couple of beers. I also know people who are terrible drivers sober, and I know for a fact I could drink 12 beers and still be a better driver. Rather then punish the act inherently, why not make it a multiplier upon an actual crime being committed? For instance, you get drunk, kill someone, get charged with vehicular manslaughter. Why not make it so that the fact that you were drunk worsens the crime, and your punishment is heavily increased?
