I don't think rights as we currently understand them are at all relevant.
That is why they immediately fell apart when our society came under attack, and why in every "rights-based" nation in the world, the government is allowed to detain you indefinitely without charge.
Suggesting that the theory needs to be revamped does not equal supporting government control of your life. It just acknowledges the inherent weaknesses of the theory, weaknesses that have really come to the forefront, as people confront the fact that we are actually a collectivized species due to our social nature. The myth of the individual is just that: a myth.
