I think it would be worse with criminal law TBH. Some judges hate defendants for some reason. You could end up with really unjust results without some kind of guidance and threat of embarassment from appellate reversal.

I'll take your word for it. Trial law never held much magic for me. Even when I wanted to be a lawyer, I still only really wanted to do corporate law. Then, I figured out that the faster way to the corner office was the MBA.
Not 100% sure I was right - since the corner office is currently occupied by a JD!

I think what they really want to give up is the current rationale behind the protection of individual rights afforded by the constitution. I am not necessarily predisposed against this point of view in the event that a more rational system of political guarantees by which the individual retains an acceptable level of autonomy can be worked out.
But in the struggle for individual autonomy the ground is hard won and not to be surrendered in any circumstance. That is the slippery slope of slippery slopes.
