Executive orders are executive not legislative. The President cannot make new law through executive order, only determine the execution of existing law or execute some other power delegated to the President.
So, attempting to use them to legislate, against the will of congress, would in fact be martial law. You could call it "soft" martial law, but it is in effect the same. Unilateral power taken by the President.

My bet is the executive order remark refers to enforcing existing legislation and the sloppy handling of state law in regards to licensing and tracking firearms, not creating new law.
