the recess appointment clause wasn't made so the president could get around the senate. it was made because the congress most of the time wasn't going to be in session. the president could wait 2 weeks over christmas if the senate isn't in session; in the modern era of almost always in actual session there is no need for this power. im not saying remove it from the constitution but it's just not valuable like it was before. all its value is now circumvention
in order to circumvent the senate's powers, the exec does recess appointments for the expressed reason of circumventing the powers of the senate
well, two can play at that game. good thing the constitution is squarely against the executive in this matter. otherwise, it truly has completely removed the senate's check on appointments
