Presumably they are suspended, as you say, why would it be an issue if they simply weren't read.
The whole enemy combatant idea seems slightly worrying as he is a US citizen. Establishing the precedent that a government can get around the law by designating its own citizens as enemy combatants seems slightly open to abuse.

oh, fair enough, i didn't read just that. you're right, an american us citizen (as he apparently became recently) being branded an "enemy combatant" on us soil is not something we ought go down.
now, there were naxi saboteurs who were caught in the us in wwii. those are enemy combatants. but this guy? he's a us citizen. it will, im sure, throw a large wrench in the immigration debate though

That is true. But even without the citizenship he would still be in the US and could still do the same thing.
